Contest Rules: AARP's 'Show Us Your Modern Family' Photo Contest

Can I Participate? Subject to the additional restrictions below, the AARP Modern Family Photo Contest (the “Contest”) is open only to legal residents of the 50 United States, the District of Columbia who are 21 years of age who are amateur artists/photographers (i.e., hobby artists who create photography as a pastime rather than as a profession and whose livelihoods are not derived primarily from the sale of their photography). In addition, to be eligible to win, entrant’s photograph(s) must be their original work and may not contain material that is sexually explicit, disparaging, libelous, indecent, obscene, or otherwise inappropriate, as determined by the Sponsor in its sole discretion. Void in Puerto Rico and where prohibited.
Professional photographers and employees of AARP (“Sponsor”) and its advertising and promotional agencies, and the immediate family members of, and any persons living in the same household as, any such employee are not eligible to enter or win. The term “immediate family members” is defined as spouses, parents, grandparents, siblings, children, and grandchildren.
This Contest is in no way sponsored, endorsed or administered by, or associated with Instagram.
Entering the Contest constitutes the Contest entrant’s full and unconditional agreement to and acceptance of these Official Rules.
Contest Description: The Contest has been established as an effort to capture the most compelling and interesting photographs of the new modern family. At the end of the Contest, Sponsor shall select between 1 and 5 winners who will be professionally photographed to appear in a 2014 issue of AARP the Magazine (the “Magazine”).
Contest Period: The contest period will begin on December 20, 2013 at 9:00:00 AM Eastern Time, and end at 11:59:59 PM Eastern Time on February 15, 2014 (the “Contest Period”).
How To Enter: 1) To enter upload images into Instagram and use the following hashtag: #AARPModFam 2) Include caption that names and briefly describes relationship of those pictured, from left to right. 3) In one sentence, describe the most interesting thing about your family.
There is no limit as to how many photographs you can enter, but each photograph must be submitted independently and through the method described above.
Photograph specifications: Each photograph must be in digital format under 10 megabytes. No print or film submissions will be accepted for entry into this Contest. All photographs must be high resolution JPEG or .jpg format. Please note that photographs need not be taken with a digital camera: scans of negatives or transparencies are acceptable. All incomplete submission emails will be disqualified. Photographs that fail to meet these specifications shall be disqualified.
Winner Selection: On or about February 21, 2014, one (1) to five (5) potential winners will be selected by our Judges based on the following criteria (“Criteria”): best exemplifies the range of modern families in America today (70%) and Originality (30%).The winner with the highest overall score shall be selected as the winner. In the event of a tie, the submission with the highest score in the “exemplifies the range of modern families in America today” criterion, as determined by the Sponsor in its sole discretion, will be deemed the potential prize winner.
Notice: The potential winners will be notified by telephone and/or e-mail on or about February 21, 2014. The potential winner may be required to complete an affidavit of eligibility and a liability and publicity release (except where prohibited by law) in order to fulfill the prize described below. All materials must be executed and returned to Sponsor by March 7, 2013. Failure to timely sign and return the affidavit or release, or to comply with any term or condition of these Official Rules, may result in the winners’ disqualification, the forfeiture of his or her interest in the prize, and the next highest scored entrant will be notified and the same process will be followed.
Prize: The one (1) to five (5) Winners will be professionally photographed in their city of residence wholly at the expense of AARP the Magazine (the “Magazine”), and those photos will appear in a 2014 special report on the modern family in the Magazine. Winner must be able to complete the photo shoot and interview by April 14, 2014.
Additional Conditions: Entrants will retain all rights to their submitted photograph -- including copyright ownership if applicable -- other than those rights licensed in these Official Rules. By submitting a photograph, you warrant and represent that your photograph is your own original work created by you, is true and verifiable, has not been previously published, has not won a previous prize or award, that you own or otherwise control all of the rights to your photograph and that your photograph does not violate any law, regulation or any right of any third-party, including but not limited to rights of copyright, publicity and privacy. Submitting an entry that is copyrighted by another individual will make you responsible for any legal action the legal copyright holder might take against you.
Entrants grant the Sponsor a nonexclusive, irrevocable, and perpetual, royalty-free, worldwide right, in all media (now known or later developed) to assign, use, license, publish, edit, adapt, modify, alter, reproduce, distribute, display, copyright, create derivative works or otherwise exploit the photographs for any purpose and without compensation to the entrant. Furthermore, by entering into the Contest, the entrants grant Sponsor the right to use the entrant’s name, city, state and country of residence and relationship to other family members in promotions and other publications and agree—all in a timely manner—to be interviewed for AARP the Magazine and pose for a family portrait by a professional photographer, such photo to appear in AARP the Magazine.
Photographs may not defame or invade the rights of publicity or privacy of any person, living or deceased, or otherwise infringe upon a person's personal or proprietary rights. Photographs that are deemed by Sponsor in its sole discretion to be immoral, obscene or not in keeping with Sponsor's image will be void. Sponsor reserves the right in its sole discretion to disqualify any entry at any time which, in the Sponsor’s reasonable opinion, endangers the safety or well being of any person or in the event it is determined that the entrants has not complied with these Official Rules.
All incomplete, damaged, lost, late, misdirected, incomplete entries or illegible entries and all entries submitted by software-generated or other automated processes will be void. Entries submitted by third parties are prohibited. Sponsor will not be responsible for failure to receive or record entries due to human processing errors or transmission or technical failures of any kind, including, without limitation, the malfunctioning of any website, computer dating system, network, hardware, or software. All decisions of Sponsor regarding the eligibility of participants and the validity of entries shall be final and binding. In the event of a dispute regarding entries, the applicable entry will be deemed to have been submitted by the owner of the e-mail account associated with the e-mail address identified with the photograph. For these purposes, an e-mail account owner shall mean the natural person assigned to such account by the Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with such account. Sponsor is also not responsible for any injury or damage to any entrant’s or any other person’s computer related to or resulting from downloading or uploading any materials in the Contest. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATIONS OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
By entering the Contest, Entrants acknowledge and agree that Sponsor makes no representations or warranties, express or implied, regarding the prize and will not be responsible for any claims, losses, or injuries arising out of the winner’s acceptance or use of the prize. By receipt of any prize, winner agrees to release and hold harmless Sponsor and Prize Provider and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest and/or receipt or use or misuse of any prize.
Who Is the Sponsor? The Contest is sponsored by AARP. All decisions of Sponsor regarding the Contest and the interpretation of these Official Rules will be final and binding on all entrants in all respects. Sponsor will not be responsible for typographical, printing, or other inadvertent errors in these Official Rules or in other materials or announcements relating to the Contest. AARP reserves the right in its sole discretion to suspend, modify, or terminate the Contest if the fairness, security, or proper operation of the promotion is compromised by a virus, errors, unauthorized human intervention, tampering, or any cause beyond the reasonable control of AARP. Should the Contest be terminated prior to the stated expiration date, AARP reserves the right to award the prize from among the eligible entries received before the termination date. AARP also reserves the right to disqualify any persons determined to be tampering with the entry process or abusing any other aspect of the Contest.
