AARP Illinois Delivers Major Wins for Older Adults in 2026 Spring Legislative Session

In Spring 2026, AARP Illinois staff and volunteers advanced our mission to empower people to choose how they live as they age by turning advocacy into action at the State Capitol.

Guided by our commitment to expand opportunity, strengthen protections, and improve quality of life for all generations, AARP volunteers and staff invested hundreds of hours meeting with lawmakers and sharing the real-life stories of our 1.7 million members across the state.

That tireless, grassroots people-powered advocacy helped drive meaningful progress to better protect older adults, strengthen caregiving, and enhance financial security across Illinois.

Here’s a summary of our hard-fought 2026 Spring Legislative Wins:

CAREGIVING, COMMUNITY-BASED SERVICES AND NURSING HOMES

Guardianship Reform: Establishes stronger standards, oversight, and transparency for private professional guardians, with clear conflict-of-interest safeguards to better protect vulnerable adults and their families.
Biomarker Privacy Protections: Expands state privacy laws to include Alzheimer’s and other biomarker tests, preventing discrimination in employment and health insurance based on sensitive health data.
Dementia Training: Requires specialized dementia training for in-home care counselors and direct care workers, improving the quality and consistency of care for individuals aging at home.
Expanded Abuse Reporting: Extends mandated reporting requirements to assisted living, shared housing, and supportive living settings—closing critical gaps in protection outside nursing homes.
Nursing Home Mental Health Reviews: Ensures timely follow-up evaluations for residents with serious mental illness and addresses conflicts of interest in screening processes.
Room Camera Rights: Expands access to in-room electronic monitoring, with proper consent, to enhance safety, transparency, and peace of mind for residents and families.
Caregiver Accountability: Clarifies responsibilities and strengthens penalties for caregivers who abuse, neglect, abandon, or financially exploit older adults and people with disabilities.

UTILITIES

Utility Public Hearings: Ensures consumers are clearly informed of their right to request public hearings and that their testimony is considered when the Illinois Commerce Commission reviews utility rate increases.

FINANCIAL SECURITY & AFFORDABILITY

Auto Insurance Protections: Enhances fairness and transparency by requiring advance notice of rate increases, allowing state review, removing unfair discriminatory rating factors, and reducing driver safety course time by half (from 8 to 4 hours) for discounts.
Home Equity Theft Reform: Ends the practice of seizing homeowners’ equity after tax sales, establishes a fair process to recover surplus proceeds, and aligns Illinois with U.S. Supreme Court protections.
Stronger Legal Tools to Stop Exploitation: Provides Adult Protective Services and courts with expanded authority—including restraining orders and asset freezes—to quickly intervene and stop financial harm.
Home Insurance Oversight: Strengthens accountability by requiring advance notice of rate hikes, enabling regulatory review, and protecting consumers from unfair pricing practices.
Secure Will Depository Option: Establishes a county-level system to safely store original wills, helping families avoid delays and complications during probate.

FRAUD

Access to Discounts: Ensures consumers can access advertised retail discounts even without digital apps, making everyday savings more accessible.
Fraud Prevention Awareness: Established a Fraud Prevention Month in 2026 to raise awareness, promote education, and protect older adults from scams and financial exploitation.
Financial Exploitation Reporting: Requires financial institutions to report suspected exploitation, authorizes transaction holds, and creates penalties for attempted financial abuse.
