AARP's Social Security Q&A Tool

My ex-spouse has not filed for Social Security benefits yet. Can I still claim benefits on their record?

En español | Maybe.  Your ex-spouse does not have to claim in order for you to collect benefits on his or her record.  However, your ex-spouse would have to be at least age 62 and you would have to have been divorced for at least two years.
