Standby guardians – State lawmakers are considering a measure that would allow chronically or terminally ill parents to designate a standby guardian for their children. The bill (HB 209), which passed the House of Representatives in January, would allow a child’s parent or legal guardian to make temporary or future plans for care without transferring decision-making power.

More than 7,000 Delaware grandparents are responsible for grandchildren in their care. More than 20 states and the District of Columbia have standby guardianship laws to help keep children out of foster care and to give parents and grandparents peace of mind.
