My brother-in-law and I want to start a long-haul trucking buisness. He's the driver (over 20 years experience) and I'm buying the truck and running the buisness. I'm thinking of two LLCs. TruckLLC to own the truck for a asset protection. DriverLLC will lease the truck from TruckLLC. Thinking of a Delaware LLCs. My brother and I live in NJ. No employees. An out of state LLC seems to make sense but am I missing anything. Truck will be registered in Delaware.
I would agree that it would seem risky to start a trucking business with the gas (especially diesel) prices where they are. I also recently set up an LLC out of Delaware but I live in Maryland and was told by the registering agent that doing business in other states requires additional filings, even for my home state of Maryland. You may want to check this out for your state and the states where you plan to do business.
