You are correct, both those Americans that have been detained as enemy Combatants are still in custody. since 2002-2003 no charges or trials as of this point. very interesting events.
1,- Yaser Hamdi, currently in Norforlk Va. 2.- Jose Padilla, alias
Abdullah Al Muhajin, I believe he is somewhere in the US but still no trial since 2003,
If you read all the articles about these men, there have been so many legal problems with them being Americans, and all the rights that as Americans we all enjoy, that I do believe that is one of the reasons that the Obama Administration abandoned the enemy combatant situation.

Jose Padilla was sentenced January 22, 2008 to 17 years and four months in prison, in U. S. District Court for Southern District of Florida.
Yaser Esam Hamdi was allowed to renounce his U.S. Citizenship and was deported to Saudi Arabia. He was originally sent to Guantanamo Bay, but when it was learned he was a U. S. Citizen, he was transferred to military jails in Virginia and South Carolina.
