Actually, the Supreme Court has held unanimously, in Muehler v. Mena, that a state or local officer's questioning a person being detained in connection with another matter about their immigration status is completely legal. So they DO have the authority to question suspects about their immigration status. That has already been determined.
How this will apply to the Arizona situation remains to be seen.
