The other point in the article is "will Congress do anything"? That is certainly not what we have seen and the far right is going all "reefer madness" . If the banks start getting into the game - the chance that the GOP will actually go against the banking industry? Somewhere I read that IL is working on legislation but the owner must have $500K to own a shop - so the folks making a profit are the top 5%.
I wonder what Ken Buck (R-CO) is saying...as he wants to be elected in 2014. GOP could be the gift that keeps on giving up seats in the Senate.

The problem for the banks is that a new president could change the rules. Your point is valid. If they decide to change the rules back, the banks are screwed. I think it is designed to put pressure on Congress to rationalize the law.
