In Response to Re: how to cope when being attacked with eviction and other surprise legal matter as caretaker when it is not your fault: I feel this is a interesting topic to start for discussion because i am sure many caretaker and or the person you are taking care of (senior or non senior) will encounter surprise attack with legal matter that is beyond your control coming in. I am noticing that many legal case(s) contain lots of errors or just data placed in to push the case and if the petitioner loses in the lower court they may keep going to the top the court system allow them to appeal and if you as the case respondent is smart enough and keep records they can lose to the top. This is something as the case respondent don't need it put extra pressure on top of handling or giving care to the needed person you are taking care of. It is best to prepare yourself or know something about what to do should surprise attack comes in. The rule is you don't want your problem also attacking the person you are caring. Tips, idea, what to do, how to prepare yourself for attack etc.... comment, suggestion etc... welcome to support anyone who can use the information. For people who are renter, many will find by surprise eviction notice or other game playing landlord can come in to attack you. Some may use attorney to do their dirty work. Knowing you are sick or are a caretaker this is one perfect victim. Question... 1) what to do when eviction or other court papers comes to you when you are caring for a needed seniors or any person any age.? 2) What if the person you are caring unfortunate also get attacked? 3) What if your landlord or their lawyer don't want to listen when you try to tell them their case contain many error information and there is no case or what I am doing is not illegal/ 4) What to do when you are trying to tell your landlord or their lawyer (the people who are suing you) you are making errors I have supporting proof you are making mistake and they refuse to listen? 5) What to do if the persion you are caring has medical or health problem and the court case petitioner refuse to backoff? etc... where can you go for help? what should you do should such emergency hits? It is better to know something about this topic rather wait till it happens and oh oh!!!! 'help!!!!!'. To start off here is my suggestion.... 1) if your resident is government regulated....Immediately take your court paper and go to the court seek pro se attorney for help its free. 2) Go to the state or federal housing dept ask to speak with a counselor to get free advise. Have with you proof that what is said in the court paper is wrong. 3) do a 2 column analysis....on the left side take apart what is said in the court paper ....on the right side comment it with where to look for the proof to proof that the comment written on the court paper is wrong. You may want to draw it out if you want. (If you are a programmer do something like a flowchart). 4) do online research on the law firm and the petitioner to see if they have bad record or review or complaint. Don't forget public record research is not illegal. 5) Have handy your state license bureau information. If they try to pull a fast one contact the license bureau, profession association etc...ask for free consultation and advise. 6) have ready or handy form to file for business or license complaint. hoping you do not need to use it. 7) If your apt is in bad shape you can co- file a hp action case to do repair. the law protect the tenant when a landlord refuse to do repair and try to kick you out. 8) Most court have free legal advise and pro se attorney that can help you. 9) Don't panic emergency pops up and you know your time will be taken away to care for your caretaker. Court will look at the subject of health or medical very strong and most of the time they give priority to anything else so if you have solid proof you cannot lose. feel free to add more comment.
