I don't know what to make of this claim from a faceless corporate book keeper that my 93yo mother didn't make a rent payment 2 years ago. I told the manager that if the payment was missed they would have discovered it a month or two later, not 2 years later. Can they legally get away with such claims?

That sounds suspicious to me. I would think it would be easy to verify if payments were missed by looking at old checkbooks, bank statements, etc. Good luck and let us know how this progresses.

The checking account in use back then was closed over a year ago and the bank changed hands since then. I contacted the bank for statements a few months ago and they said they would send them but I didnt receive anything.

I had a simular situation a few years ago, over a credit account that was not "paid in full". I asked for the proof they had, or something verifiable, that I could have my lawyer examine. I was never contacted about it again.

Sometimes I get calls about off the wall stuff, and I just know it's a scam.
I allways tell them to send me some legal documents, and my lawyer will handle it. Nothing ever comes in the mail.

So don't get pushed around. Tell them you need the proof they have. A mistake in their own bookeeping is no reason for you to pay again. This sounds like someone thinks they can take advantage of a 93 year old woman.

That was my thought as well, people of that age are easy targets. When she moved into the El Dorado it was owned by a family business and the management was service oriented. They said the bldg was due for renovation and gave my mother 3 mo free rent as an incentive to move in. Soon after that they sold the complex to Holiday Retirement, a big corporation and changed the management to where theres a new one every couple of months. There was no further talk about renovation either and rents have gone up 10% each year. If they push their claim I'll ask them for proof.
