A new article from AARP Bulletin describes six ways scammers try to rip you off while pretending to help you avoid foreclosure. These scammers are increasingly targeting people 51 and older; in fact, during the first six months of 201, some 40 percent of victims were in that age group. Genesis Financial LLC Andrea Kooiman; Rachel Maese; Cynthia Morales; Brian Kissinger; Corey Kulik, Dawn Young The company and its associates have been scamming people into believing they can help and prevent foreclosures/sale dates from happening. I know because I just realized now that I am one of their victims from Rialto, California

The company and its associates have been scamming people into believing they can help and prevent foreclosures/sale dates from happening.  I know because I just realized now that I have been a victim.   Several months ago I paid them for their services.  They promised to add me to an ongoing lawsuit against the big mortgage banks (my lender being one of them) and to keep a constant eye on any foreclosure activity on my home with the goal to obtain a loan modification in my favor.  This all happened back in March of 2011.  Since then, they have only attempted to communicate with me a few times via email and by returning my phone calls but that stopped beginning in July.  Since the last email in early July I have not received any kind of communication from them. Now they are close to your neighborhood in Dana Point and They have not been returning my phone calls and emails to them.  In fact, emails have been returned back to me un-deliverable.  Do not believe in Genesis Financial LLC and any of its representatives/associates and run to the hills if you are being suckered in paying them for any help/services.There is a list of 378 victims that paid $3,000.00dls each and that accounts to $2,134,000.00 defrauded already and more to be counted now that they are in Dana Point.
It is only a matter of time when the CA Attorney General hears about this and puts them on her radar.  The internet is chock full of websites/webpages reporting this company and its associates.  I will pray that some agressive lawyer of your community go and stop these thieves soon, Brian Kissinger and Rachel Maesse arethe ownersof this outfit.

Yes, I ws also a victim of a loan modification scam. The company's name is A-New Beginning out of Torrance, CA. The owner, Cindy Bui and her scam artist, Bran and Anthony were very good at convincing me that they could help me get a loan modification. I paid $1,600 in advance. They assured me that they had connections at Chase an that I qualified for a reduction in interest and possibly the principal. Well, to make a long story short, Cindy Bui submitted incomplete paperwork, copies that were not clear, ignored th phone calls from the loan modification officer reviewing the paperwork, etc. In short, the service from hell! The end result is that the loan modification was denied becauseI was making enough to satisfy  the ratio of gross income to mortgage payment which is1/3 of gross income, Now, I submitted a w-2 and pay stubs to A-New Beginning, therefore, they had to know that I did not qualify for the modification if that was the only criteria Chase was looking at!

Please beware, the last time I looked at the website, they were targeting seniors by ofiering discounts. Cindy Bui is now working for  a newcompany in Los Angeles, Homestead Solutions or something to that effect.

Why did you not know the eligibility requirements of the loan modification before you began the process?

I find it hard to understand why people put such faith in others and do not put forth the effort in understanding the (whatever) process and most importantly understand what they are signing and paying for in an agreement.

Don't put your faith in what other say, know what you are doing, what you are signing and what you are paying for or it will continue to occur.

If this was a government sponsored modification program - (Fannie Mae or Freddie Mac owned loan), even your congressperson's office could have helped you understand the eligibility, conditions and possible outcome.


Making Home Affordable Government Sponsored Program to help those eligible to save their home.

There is even a new one to help those who are current and only underwater (Loan Value to Market Value) to refinance their home at a lower interest rate - hoping to stop them from just walking away.  It is called HARP (Home Affordable Refinance Program) Phase II.  Details should be available about the 1st of 2012.


Why pay for something that you possible could do yourself or with the help of a trusted helper?

Sorry this happened to you, maybe the HARP Phase II will benefit you if you and the home meet the government eligibility requirements.

Ok, put down the torches and rope folks and let me say that I have no affiliation with Genesis Financial and only met Mr. Kissinger within the past two months; however, I spent a great deal of time with him in December at the Monarch Bay property and I read his standard contract word for word and while I'm not admitted to the bar in CA, I am a retired Real Estate Broker (25 yrs) and that contract did in no way make any promises of any end results. Furthermore:
  • I saw documentation attesting to the fact that Genesis offered refunds to disatisfied customers.
  • I personally witnessed Mr. Kissinger working night and day negotiating with lenders on behalf of clients..
  • I witnessed him save more than one home from forclosure at the 11th hour and those families' homes are still in their possession.
  • As far as I know, there are about 50 customers who were rallied up by one clint into a frenzy and that Genesis did in fact help 100's of clients sucessfully.
I know that it is easy to point the finger for losing your homes but to slander a good man's name for doing what you paid him to do (as per contract) then cry wolf when you don't get the results you had hoped for is just sucker punching.

yeh sure put down the torches .Brian kissinger was arrested on Dec 15 and bonded out almost 90 days later .Look it up on google if you dont believe me.How could you be meeting with him in december if you are not the one and same.I want my money back you crooks .Please just remember there is a special place in hell for people that take advantage of people who are down on thier luck ...Karma babe .You are a piece of work ..I mean he is ....Wait i think you are both one and the same....Have fun in the shower convict.

This is from his previous scam in 2009 its the same MO  you should do a search on the people you endorse nice picture by the way " I started working with FLM January 5th. We attempted to modify a first and second mortgage. They charged us $4200 up front. We were promised by Mr. Kissinger that they would get us a buyout of the second and a principal reduction and rate modificaiton on the 1st. He said they were a group of 50 lawyers tied into he government as well as all the major lenders and servicers. This should be no problem he said and should take less than 90 days but most are complete within 45. We agreed that I would pay half upfront and half when the job was complete. 2 weeks after we started the charged my credit card again for he second half. I complained and they said they would refund the entire amount if they could not do what they said.
During the process, they lost my file, never followed up to see if the lenders actually got their "Package", and dragged their feet due to "Changing programs with the goverment and lenders". We were bounced around from no less than 10 people. Our final person what a man named David Lockwood who was helpful to a point. He did say at one point that my lenders would not deal with me because I was not late on my payments and my interest rate was below 7%. He said foreclosures had priority. He advised becoming late so they would deal with me. We are now 5 months into the process and I've asked for refunds several times. Now I can't raise them on Email or Phone. I found out that the FTC has essesially shut them down. We are working with our lawyers to try and get our money back but we're not holding our breath. Sad thing is $4K rignt now would help get us back on track. We are late on mortgage payements and our credit has been destroyed. I'm attempting to work directly with my servicers and I'm finding them very helpful. Hard lesson to leran that we never needed these people in the first place! Buyer BEWARE!
