Savanna,
That is complicated. But Social Security is Federal and if you get benefits, you get them anywhere you go in the USA. When I collected a check for my daughter I was receving Child Support and I received an SS check for her and medicare and medicaid for what medicare did not cover, even though my x-husband kept my daughter insured on his insurance policy. My SS was all drawn on my own account. But at the time time I had not work enough with a high enough wage but I got $1500 for me and $800 for my daughter plus medicare. Had I not had my own account I was told I could draw off my x-husbands account for my daughter and SSI for me, but that wasn't necessary. However, I think there are divorce laws here as far as you collecting off your husbands account for your self. I think there is something about if you have been divorced 10 years or more, you can not collect off his. But his biological child can. If I were you I would just call SS and learn exactly what you are entitiled too

Hi Savannah,
I am not sure about you collecting from your X-husband's account, but there may be some law pertaining to how long you were married and how recent the divorce. However, I do know you will get more money if you wait until you are full age retirement 65 or 66 to collect benefits. But there is also a benefit for disable children or disabled depndents. You may be able to collect from your husbands account for the dependents if the disabled adults are children from you and husband. If they are not your children, then you may be able to collect SSI disability for them or benefits from the County. I do know that when I was on SS disability and still raising my daughter, I could receive a check for my daughter from SS from either account when I was divorced along with my own benefit check. . I chose my own account. At any rate, if you collect your own Social Security, you should also be able to receive a check for each disabled dependent along with your own check. Just call Social security and they will tell you for sure. If they say no, ( which I do not think will be the case) You can check with the County office. But I think you can get SSI for the dependents. SSI is for people who do not have enough money into Social Security system to claim regular benefits. It's sort of like Social Security welfare. Hope this helps.

"Thanks" for all the info...one of my chilren has a friend who is disabled and he collects SS from his dead fathers account. I have not worked much in my lifetime, lots of years at home taking care of my children while married,I do beleive I have enough credits to collect a very very small amount on myself...which i would do now...IF when the ex retires and starts to collect SS I could drop my benefits and then start taking benefits off of his as his ex wife. I was married 25 years, divorced now going on 15 years. The situation is 'strange'.my children get child support now from their father but ONLY because as the decree says "they need ongoing supervision" concerning 'daily activities'.the SS would come to them just because they are 'disabled'.supervision is not required.(a caregiver living with them is NOT necessary). i just wonder if the amount I would get would be different based upon...1.I am the caregiver and living with his children or 2.I just get the benefits no matter where I live.
Figure this one out..my child got SSI while I was still married to the father who made six figures a year that the child benefited from.I got divorced, the SSI was taken away cause child got Child Support. REALLY DUMB since the CS was 'tiny' amt. compared to the six figure income that benefited the child. and I can't get any benefits or help from agencies because the CS is counted as MY income which it is not. How can the fathers HUGE income(household amt.) NOTcount against the SSI so my child got it while I was married to their father and now the income(household amt.) is very small and they can't get SSI. Household income is household income..the fathers when he lived here six figures.and.now HOUSEHOLD income is tiny. Just because some of it comes called Child Support does not explain why with a huge amt.household they got it..and NOW with a tiny amt.household they don't.Household income either should or does count against you or it should not.Meanwhild Illegals get benefits
