Ok, some more fun facts to think about, why America is in so much trouble!!!!

  • India set to explore the moon’s surface - in a small blurb in the Dallas QUICK newspaper, it is said that India launched its first mission to the moon yesterday to redraw maps of the lunar surface. OH JUST GREAT!!!!!! So now, NASA will start to OUTSOURCE to India for space flights???? Or will India become Mission Control? LOL!!!! Imagine, it is hard enough to understand them when you call something like Earthlink or Microsoft’s tech support line for help - imagine if you are on a space mission and suddenly you are losing all your oxegyn? Helo this is Biff(***) blah blah blah. Did you check to make sure the electrical plug is inserted into the wall socket? Blah blah blah . . . . . And would you be interested in purchasing our Gold membership plan that includes . . . . . hello sir, are you still there sir????
  • Fraud evidence is lost in crash -  A massive computer crash destroyed hundreds of Austin’s state attorney’s confidential documents that may prevent scores of Medicaid fraud prosecutions from being taken to court! It has revealed problems with a newly expanded OUTSOURCING of state computer services!!!!! Hmmm, they must have called Bif from tech support up above??????
  • Bilingual teachers protected from layoffs in Dalls School Districts - With all the messed up layoffs in the Dallas school district, they are PROTECTING the bilingual teachers over the regular ENGLISH speaking teachers?????? Just HOW will these students ever feel the need to LEARN ENGLISH, if they are specially catered to???? It is said that 53,785 students have a poor proficiency in English now as it is, or 34% of total enrollment. Hmmm, and seeing as the head of the district, also the one who CAUSED the problems leading to the layoffs, is Latino himself??? I would have thought I would want an English speaking teacher to teach me proper English. Or AMERICAN history?
  • Reaction to drugs on the rise - Seems that the number of serious reactions, even DEATH, to drugs are on the rise, so says some watchdog group. Hmmmm, one of the drugs is called Chantix. It is an ANTI-SMOKING drug! Hmmmm, guess all those anti-smokers really want us to quit - BY KILLING US OFF!!!!!!!! Gee, thank you for caring that I don’t smoke anymore - NOT!!!!!!!!
  • Stocks plunge again - Hmmm, it is said that because of corporate proffit forecasts, a jump in the dollar, and falling oil prices signaled investor fears that an ecconomic slowdown will sweep the globe even if lending is seeming to return back to more nornal levels. Like DUH????? Don’t we WANT our dollar rising back up in value? Like double DUH don’t we just LOVE the gas priced getting affordable again???? DAMN these people in Wall Street and the stock markets!!!!! Damn all those speculators!!!!! They are the ones who keep getting us into these messes. They play with our lives like we are just meat puppets!!!!
  • Spreading the wealth isn’t new - McCain is trashing Obama yet again - does he do ANYTHING ELSE now a days, other than to trash talk Obama? Seems like his whole campaign now is soley to trash the other guy, and never say anything else - like how he is going to fix things! Well, McCain is trashing Obama this time about wanting to shift more wealth from the richer Americans to the poorer ones. He calls it socialism. McCain is trying the old switch-a-roo by trying to sway voters away from seeing what is actually happening -  his trying to fuel middle class resentment towards the poor, all the while protecting the wealthy (like him and his backers???). Honestly, with the soaring prices of healthcare - maybe some parts of socialism would not be too bad. Imagine, not having to pay $$$$ for medical benefits? Next to buying a house, or a car - the real major cost for anyone is medical bills!
  • T. Boone Pickens gives local YMCA $5M donation - Yeah, nice rich guy, huh? Gives five million dollars to ONE YMCA for remodeling. Everyone makes him out like a hero, a real swell guy. Even gets his name now on the building too, NOT!!!!!!! That five million was just a spit in the bucket for him, and most likely gave him a nice sweet fat & juicy TAX WRITE OFF!!!!!! Give me a BREAK! So many times we read about some rich person donation money, and made into a hero. But where they give that money to, it is usually quite limited.  Rish people are not dump - they got rich by being smart - and trampling all of us into the ground to get there along their merry old way. Many years ago, a friend of mine told me about some rich guy he knew. They guy went and spent $60K on something as a tax write off - just so he could get OUT OF paying $6K in taxes!!!! And though I forgot what it was he bought, but it was something useful. So he didn’t even suffer like the rest of us hard working folks who slave just to put a meal on the table for our families! HEro, yeah right!

***: in case some did not know, many companies HAVE had complaint calls about not being able to understand the person on the line giving them tech support (from India). So many companies, thinking that WE are all IDIOTS and would not know the difference, have forced their (Indian) employees to change their names to American sounding names like Bob, John, Sam, etc . . . thinking we would be fooled. NIOT!!!!! Like changing their names would help us understand what they are saying would work???

The case was quickly settled out of court. Later I was at the racket club (all of us were members of the local racket club, both attorneys as well as the owner of the business) with the lawyer who represented the employer. We were both in the local Jaycees and he said that bringing my daughter to the deposition was a stroke of genius, that he advised his client to settle quickly since a verdict in a trial would likely put him out of business by awarding punitive damages. He said those actions had cost the company more than a million dollars with the largest part being a fine by the Department of Labor for more than a 500K. He had to pay all the medical expenses (this was pre COBRA) associated with the pregnancy, back pay with interest, 'pain and suffering' damages as well as all attorney and court costs.

The lawyer told me that he had been advising that business owner that he can't run his business like a plantation and that what he was doing was wrong. The manager was fired soon afterward and his reputation in that town (Sandusky OH) was so bad, he couldn't find anyone there who would hire him. He wound up moving out of state.

In 1999, that company became a client of mine with a new owner. In 2004, that attorney who represented the business was elected a common pleas court judge as a democrat. The lawyer who represented the fired woman represented me a year later when my wife and I divorced.

Businesses that act like the one you describe won't last long. Look for them to go out of business

Here is my personal story about lying and unemployment. This happened almost thirty years ago but it shows how what goes around comes around. My ex-wife worked part time as a bookkeeper for a local company that had their office a block from where we lived. She was six months pregnant with our second daughter when she was called into the office and let go. She filed for unemployment benefits and her case was approved.

Then the company filed an appeal. The manager said that she was offered full time work and refused which was a bald faced lie. The hearing was held and my ex wife showed up 8.5 months pregnant and told the hearing examiner that was a bald faced lie. But the unemployment people believed the manager anyways and denied her claim.

I had a relative who was an attorney and he referred us to a trial lawyer who said her case was a slam dunk for pregnancy discrimination and offered to sue the employer without asking for any retainer. My ex refused because it didn't involve that much money and with a new baby simply didn't want the hassles.

A year later that company pulled the same stunt with another pregnant woman, only this gal was a full time employee and her husband worked in construction so they needed her health insurance. Of course she lost the health insurance with her job and the manager lied about unemployment again saying she was let go because of poor performance.

This gal sued charging pregnancy discrimination and called my wife in for a deposition. When she came, I accompanied her and took our daughter who was now a 18 months old. The presence of our daughter rattled the employer and their lawyer, but we just sat on the side quiet, not saying anything while my wife related what had happened almost two years earlier.

I don't know all the specifics about your situation, but you can make life miserable for that company that shafted you. Is it a large national corporation? Are others in the same boat as you? Very often companies that have such sleazy managers and operate like you describe have shafted others and get away with it simply because people do not speak up for their rights.

You can file a formal complaint with your OEO office since you are over age 40 and file on age discrimination. You may also want to talk to an employment attorney who handles cases like wrongful discharge cases. You may also want to send a letter to the head honcho at the corporate office explaining your situation. You may also want to contact a local investigative reporter about this company.

Finally if there is some kind of a Job Center that assists laid off people find other employment, you may want to seek that out. I don't know if those offices exist in Texas, but they are all over here in Ohio. They provide access to job leads, assist in preparing resumes and interview preparation. They also offer a support group that can provide emotional support as well as exchanging contacts and job leads.
